Order BERORE: KEITH, BROWN, and MARTIN, Circuit Judges This matter is before the Court upon consideration of the appellant David Chaniott's response to this Court's order to show cause why his appeal should not be dismissed for lack of jurisdiction because the notice of appeal was not timely filed. From the record it appears that on September 25, 1978, the District Court entered on order adding David Chaniott as a party defendant and at the same time dismissing the case for lack of jurisdiction. On September 26, 1978, defendant Nabisco, Inc. served a timely motion to vacate the order under Rule 59(e), Federal Rules of Civil Procedure, and on the same day, an order denying said motion was entered.
